General Business Terms and Conditions
Discover Culture (Opera Guide GmbH) is hereinafter referred to as Discover Culture.
§1 Business Objective:
Discover Culture procures tickets on behalf of and at the risk of its customer. By placing an order, the customer makes a binding order to obtain the admission ticket. Discover Culture assumes no liability whatsoever for the events themselves. Discover Culture assumes no liability whatsoever in the event of illness, other reasons for the customer's non-attendance or in the event of cancellation or program changes by the organizer. The return of tickets is excluded, unless this is provided for other compelling legal reasons and the ticket price is not refunded by the organizer.
§2 Concluding Contracts
Data and information on all events offered by Discover Culture are carefully researched and regularly updated. However, we can accept no liability for the completeness, accuracy or currency of such information. Details given by Discover Culture with regard to individual events are non-binding. It is customers who offer to conclude a contract, by clicking on the "Place order" button. Such offers are binding on customers. Any subsequent order confirmation that is sent does not constitute the conclusion of a contract on the part of Discover Culture. A contract is only concluded when Discover Culture sends confirmation of booking to the e-mail address provided by the customer. Orders are therefore binding on customers from the time they are placed, even if contracts are concluded at a later date.
§3 Right of cancellation
Pursuant to Section 18 (10) of the Austrian Distance Selling and Foreign Transactions Act, customers do not have rights of cancellation as detailed in Section 11 (1) of the Act with regard to the following contracts: Services relating to accommodation for non-residential purposes, the transport of goods, the hiring of motor vehicles and the supplying of food and drink, and services relating to leisure activities, provided that the contract stipulates a specific time or period for the fulfilment of its requirements by the operator in question. As the services offered by Discover Culture relate to leisure activities, in particular tickets for events, there is no right of cancellation. Each order for tickets therefore becomes binding immediately it is placed and customers are required to accept it and pay for the tickets they have ordered.
§4 Right to cancel (only applicable to vouchers)
You have the right to cancel this contract 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail).

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
This policy is only applicable to vouchers.
§5 Prices:
All prices are inclusive of any taxes and duties, but exclusive of shipping charges, which vary depending on the type of delivery chosen by the customer. The legally prescribed sales tax of the respective country is used.
Our prices include various procurement and processing fees (agio). The final price to be paid is broken down into the basic price + agio before the order is completed.
An additional service fee of €6.50 is charged for each purchase. This is clearly displayed in your shopping cart. The service fee includes our telephone assistance during the ordering process, in the event of cancellations or rebookings of events, as well as our written or telephone advice on selecting events and for any questions you may have.
All ticket prices are rounded up to the next full euro.
The customer authorizes Discover Culture to debit the payment from the specified account or credit card after receipt of the order.
§6 Payment:
You may choose to pay using your credit card or the automatic debit transfer system. We accept the following credit cards: VISA, MasterCard, American Express and Diners Club. Automatic debit transfer system - Payments are currently being accepted via this system for the following countries: Austria, Germany and the Netherlands. Your credit card account or bank account will be charged immediately after your order is completed.
§7 Annulment, Cancellation of Event:
Discover Culture is not liable for the reimbursement of admission charges for cancelled or rescheduled events, for example. These claims are to be enforced by the customer directly with the holder of the event, such that the terms and conditions announced by the respective holder of the event for ticket return apply. Discover Culture shall strive to support its customers in the course of enforcing these claims, but it is not obligated to do so. As a rule, tickets can only be redeemed at the cashier counters of the holder of the event and at the price printed on the ticket. In case that reimbursement for the booking, the procurement and the shipment of the tickets was also included along with the ticket price determined by the holder of the event, any refund of this reimbursement by Discover Culture shall be excluded, as Discover Culture fulfilled its side of the contract by providing the tickets.
§8 Validity of Vouchers
The voucher is valid for three years from the date of issue. After this period of validity has expired, the voucher holder has the option, within a further period of one year, to extend the voucher once for another year or to have the voucher value or remaining voucher value refunded, less an amount of EUR 15.00.
§9 Events Bookable 1 Month in Advance at the Earliest:
With some holders of events tickets can as a rule only be booked bindingly 1 month prior to the date of performance, at the earliest. In this case, the points-in-time of the charge of the reimbursement and the confirmation of the booking by Discover Culture are temporally separated, in particular the mere charge of the reimbursement not representing any booking confirmation. Should the event ordered by the customer no longer be bookable, any sum that may already have been charged by Discover Culture shall be restituted forthwith.
§10 Exclusion of Liability:
Discover Culture does not bear any liability with respect to the customer for the contents of the events listed. The customer acknowledges that the respective holders of events have as a rule reserved the right to make changes in casting and program. Discover Culture is in particular also not liable for (frustrated) efforts that the customer has expended arising from any possible cancellation, rescheduling, or program or casting changes, particularly those such as travel and sojourn expenses incurred. The liability of Discover Culture is in any case limited to at least grossly negligent behavior on the part of its employees.
§11 Applicable Law, Court Venue:
Agreed upon is the application of Austrian Law under exclusion of the conflict rules as well as of the UN Convention on Contracts for the International Sale of Goods. The court having jurisdiction and competence for the 1st Municipal District of Vienna is agreed upon as court venue hereunder.
§12 The text of the agreement:
We will save the text of the agreement and send you the purchase order information via e-mail. You can view your previous orders in our customer login section. You have the possibility of completing the purchase order in German or English.
§13 Contact details for personalization
As part of the measures to contain the COVID-19 virus and the related regulations of the health authorities, it is necessary for some organizers to determine the names and contact details of all people who will attend the performance . If this is the case, Discover Culture will contact the customer personally and request them to disclose this data.
This data is passed on to the organizers to process the booking and, if necessary, to the authorities, but not used for other purposes.
The need to record data does not entitle you to withdraw from the booking. If Discover Culture does not receive the data after being requested to do so twice, the booking will be canceled with any processing fees retained.
